- What Personal Information Do We Disclose? We have disclosed personal information about consumers, with their consent, as detailed above in Section 3. We do not use or disclose sensitive personal information.
- What Personal Information Do We Sell or Share? In the preceding 12 months, we have shared personal information as detailed above in Section 3. Also, in the event that we, or substantially all of our assets, are acquired, such personal information may be included within the transferred assets. In the event we become the subject of an insolvency proceeding, whether voluntary or involuntary, we or our liquidator, administrator, receiver or administrative receiver may sell, license or otherwise dispose of, such information in a transaction approved by the court.

We may at times need to request additional Personal Information from you, taking into consideration our relationship with you and the sensitivity of your request.
The information which you provide in conjunction with your request will be used to verify your request and to attempt to identify you within our data records. The information which you submit in conjunction with your request to know will be used for the express purposes of verification and providing you with responsive information to your request, if required. Please note that we utilize a two-step process for requests to delete, whereby you first submit your request to delete, and second, you separately confirm that you want your personal information deleted. The CCPA permits requests to know regarding collection and sale or sharing from the same consumer no more than twice in a twelve (12) month period. - How an Authorized Agent Can Make a Request Under the CCPA. If you elect to use an authorized agent to exercise your right to submit a request to know, request to delete, and/or request to correct, before processing the request, we require the purported authorized agent to provide proof of your signed permission to submit the request (unless there is a power of attorney in place pursuant to Probate Code §§ 4121-4130). We also require that you directly verify your own identity with us, and directly confirm with us that you provided the authorized agent permission to submit the request on your behalf. The information submitted will not be used for any purposes other than to verify the request, fulfill the request, and fraud prevention.
- Updates. We may revise this section from time to time as implementing regulations further develop and come into effect and we are able to provide you with better information on your CCPA rights and how to exercise them.
- Retention of Personal Information. We retain personal information as long as is reasonably necessary to fulfill the purpose for which it was collected, as required by an applicable law, rule, regulation or contractual provision. Please note that we must be able to authenticate, with commercially reasonable effort, the identity of the consumer and the authorized agent’s authority to act on such consumer’s behalf, by requiring the following information: the Colorado resident’s first and last name and Colorado address, and proof that such Colorado resident has authorized the agent to submit a request on their behalf.

Texas residents are permitted to designate another person to serve as their agent and act on their behalf as an authorized agent. VI. Utah Residents – Your Privacy Rights

- – Right to obtain a copy/portability: may obtain a copy of the consumer’s personal data, that the consumer previously provided to the controller, in a format that: to the extent technically feasible, is portable; to the extent practicable, is readily usable; and allows the consumer to transmit the data to another controller without impediment, where the processing is carried out by automated means;
- – Right to opt-out of certain data processing: may opt-out of the processing of personal data for purposes of targeted advertising, or the sale of personal data.

We require the following information to authenticate your identity: your first and last name and a Utah address. Please note that We must be able to authenticate a consumer request to exercise a right under the UCPA, using commercially reasonable efforts.
VII. Virginia Residents – Your Privacy Rights

We utilize a two-step process for online requests to delete, whereby you first submit your request to delete, and second, you separately confirm that you want your personal information deleted.
To the extent that your personal information is necessary for us to maintain for a reason delineated in Cal. Civ. Code § 1798.105(d), including but not limited to complete a transaction for which the personal information was collected, provide a good or service you have requested, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, debug, etc., or to comply with a legal obligation, we are not required to comply with your request for deletion. For instance, we are not required to delete personal information which is necessary to maintain suppression files for those individuals who have opted out of receiving email marketing from us. Your Right to Non-Discrimination for the Exercise of Your Privacy Rights
California affords consumers with the right not to receive discriminatory treatment by a business for the exercise of their privacy rights conferred by the CCPA. This means that you cannot be denied goods or services; be charged different prices or rates; be provided with a different level or quality of goods or services; or have it suggested that you will receive a different price or rate or different level or quality of goods or services. However, a business may offer a financial incentive or price or service difference if it is reasonably related to the value of the consumer’s data. A business shall notify consumers of any financial incentive or price or service difference.

Sharing Personal Information

Access to Specific Information and Data Portability Rights

Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.

Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request here. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Personal Information Sales Opt-Out and Opt-In Rights
We do not knowingly collect information from individuals under eighteen (18) years of age. No information should be submitted to, or posted at, our websites by individuals under eighteen (18) years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time. To request that we do not sell your personal information, click the Do Not Sell My Personal Information hyperlink located near the bottom of the landing page on our website.
Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by visiting our website and sending us a message. We will only use personal information provided in an opt-out request to review and comply with the request.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
